Duncan’s practice comprises civil litigation, family law and public law.

Duncan represents both claimants and defendants in small, fast and multi-track cases involving disputes based upon the common law of contract and torts as well as in residential and commercial property disputes. He represents clients in cases of personal injury, predominantly in road traffic matters.

Duncan has a family practice focusing on divorce and all related aspects of ancillary relief, including TOLATA. Duncan also covers the full spectrum of applications that can be made in respect of private children work and has experience of proceedings brought under the inherent jurisdiction of the High Court.

His experience in Public law includes work for both Local Authorities and individuals in housing and property cases and in immigration law including judicial review. Duncan regularly appears in the AIT and has represented appellants in the High Court in judicial review cases often including human rights claims. He has represented a wide range of appellants in cases involving Articles 2 (right to life), 3 (prohibition from torture) and 8 (right to private and family life) of the ECHR.

Duncan has lectured at Queen Mary, University of London in public and administrative law and maintains his interest in the academic side of the law.

Beyond the law Duncan enjoys photography, all things New Zealand, and sports, in particular, skydiving.
